These Terms of Service govern the use of Optiviera and define the legal framework between the user and AkkisTech, operated by Kerim Akkis.

Important legal notice

Optiviera is currently provided as beta software. While AkkisTech applies reasonable technical and organizational measures to protect the platform, the service is provided on an as-is and as-available basis. Users remain responsible for independent backups, lawful data processing, and evaluating whether the beta version is suitable for their operational needs.

Beta Software

Optiviera is currently in beta stage and may contain defects, incomplete features, interruptions, or technical inaccuracies.

  • Errors and interruptions may occur
  • The service may not be suitable for critical production workloads
  • Use is at the user’s own operational risk

Platform Security

Protected

The provider applies reasonable security measures to protect the platform and reduce unauthorized access risks.

  • Technical and organizational safeguards are applied
  • Access to the platform is protected by security controls
  • No absolute security guarantee can be given
  • Security measures do not replace user-side risk management

Backup Responsibility

User Duty

Users are solely responsible for maintaining current, complete, and independent backups of their own data.

  • The provider is not the user’s backup operator
  • Users must export or store backup copies independently
  • Data loss, corruption, or deletion may occur
  • Recovery of lost data cannot be guaranteed

Liability Limitation

The provider’s liability is limited to the maximum extent permitted by applicable law.

  • No liability for indirect or consequential damages
  • No liability for lost profits or business interruption
  • No liability for data loss caused outside intentional misconduct or gross negligence

Beta Awareness

Users must evaluate whether and to what extent the beta software is appropriate for live business operations.

Users must not rely on the beta version of Optiviera as the sole system of record for critical business continuity unless they have implemented their own safeguards, backups, validation processes, and internal controls.

The current version of Optiviera is not marketed as a fault-free or uninterrupted production guarantee.

Important beta disclaimer

By using Optiviera, the user acknowledges that the software is in beta stage and that technical issues, functional limitations, performance problems, incorrect outputs, interruptions, and data-related risks may occur. The provider does not guarantee uninterrupted service, fault-free operation, or permanent data retention.

  • The software may contain bugs or unfinished features
  • Unexpected behavior or incorrect processing results may occur
  • Temporary or permanent data loss cannot be fully excluded
  • The user is responsible for backup and operational validation
  • The provider may modify, suspend, or discontinue features at any time

Acceptable Use

The platform may not be used for unlawful, abusive, fraudulent, harmful, or security-threatening activities.

Data Protection and GDPR

Users remain responsible for the legal basis, lawfulness, and data protection compliance of the personal data they process.

  • Users remain responsible for their own data protection obligations
  • The provider acts as processor only to the extent applicable under GDPR and contractual arrangements

Warranty and Liability

The service is provided without warranty except where mandatory law expressly requires otherwise.

  • No warranty of uninterrupted or error-free operation
  • Liability is excluded except where mandatory law provides otherwise
  • Any unavoidable liability remains limited to the legally required minimum framework

Suspension and Termination

The provider may restrict, suspend, or terminate access where required for security, legal, operational, or contractual reasons.

  • Access may be suspended to prevent abuse or security incidents
  • Access may be terminated in case of violations of these terms
  • The provider may discontinue beta access or specific functions at any time

Applicable Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, to the extent legally permissible.

  • German law applies unless mandatory law requires otherwise
  • Place of jurisdiction shall be Bremen where legally permissible
  • If individual clauses are invalid, the remaining clauses remain effective
